dc.description.notes | This report presents an overview of the nature of sexual offence proceedings and the role of cross-examination in ensuring the accused is accorded a fair trial before canvassing the arguments for and against allowing an unrepresented accused in sexual offence trials to cross-examine the complainant. Whether or not the courts should retain discretion to allow cross-examination by an unrepresented accused in certain cases is then debated and the Commission’s position on the issue is outlined. Recommendations as to what procedures should be followed where an accused is prohibited from cross-examining are provided and the potential impact of these changes are discussed in terms of the right of the accused to a fair trial, the rule in Browne v Dunn and the presumption of innocence. The desirability of alternative arrangements in certain cases and the need for flexibility in procedures are also noted. While the Commission recommends a blanket prohibition on an accused cross-examining a sexual offence complainant, the need for the development of a range of safeguards, such as a warning to the jury and ensuring the availability of legal aid, is emphasised. | en |
