dc.description.notes | "January 2005"<br/ >"Funding for this project is provided through the National Initiative to Combat Sexual Assault - an Australian Government initiative administered by the Office of the Status of Women. "<br/ >See also Prosecutorial decisions in adult sexual assault cases : an Australian study:on our Research & Resources database.<br/ >Paper summarises findings of a study that analysed the exercise of prosecutorial discretion, and the factors involved in prosecutorial decision making and charge negotiation in sexual assault cases across five Australian jurisdictions. A survey was conducted of 141 Director of Public Prosecutions (DPP) case files relating to 148 victims and 152 defendants from which statistical data relating to victim, defendant, case characteristics and case outcome was extracted. The results suggest that only a very small number of sexual assault cases proceed to trial and even fewer result in a guilty verdict, the majority being either withdrawn or finalised by way of a guilty plea. Factors associated with case decisions and factors predicting case decisions are presented and discussed. | en |
