This briefing paper was published in light of the New South Wales Government’s 2012 Inquiry into the partial defence of provocation. It provides a legal background to the operation of the defence in NSW, as well as an explanation of similar defences in other Australian jurisdictions. The authors canvass a series of criticisms which have been levelled at the formulation of the defence including the gender bias inherent in the defence which prejudices women who kill their abusive partners.en
