dc.description.notesGeneral Overview: This is an excerpt from a paper delivered at the DVIRC Annual Family Law forum held in Melbourne. The author discusses developments in understanding and knowledge about the mediation of family disputes. She then discusses immediate challenges in the Australian context resulting from the introduction of the 2006 shared parental responsibility amendment to the <i>Family Law Act 1975</i/>. Reference is made to the author’s co-research carried out with family dispute resolution (FDR) practitioners around the interpretation of the legislation. Issues surrounding the notion of neutrality in court decisions and the presumption that both parents have equal or substantial time with children are discussed.en
