This article provides a brief of the outcome of 'Doherty' where a husband was awarded 35% of property, and the wife 65%. The trial judge recognised the relevance of the husband’s violent behaviour towards his wife and children when assessing the distribution of property. Discusses the implications of the ruling. It represents a change from previous approaches taken by the courts, which have viewed family violence as irrelevant.en
