Overview: This Australian paper explores the gap between the experiences of women affected by domestic violence and the policies and legislation that have been put in place to assist them to stay in their homes and have the violent partner removed.<br/ ><br/ >Discussion: The paper looks at the changes in attitudes, legislation and policy over the last 30 years and also examines the experience of leaving or staying in a violent relationship, with regards to belonging to family and place, and the effects of either choice. The author concludes that the question ‘why doesn’t she leave?’ is still asked, while the question ‘why doesn’t he leave’ is rarely asked. There is an assumption that women and children are less entitled than their violent partner and father to remain in their own home.en
