Notes:  Provides an overview of the nature, incidence, characteristics and risk factors associated with elder abuse in Australia before presenting some of the legal issues which may arise in relation to this form of abuse. Highlighting the relatively low reporting rates of abuse amongst elderly victims, the case study of Mrs Smith is used to illustrate the myriad of ways in which the legal system can impede, rather than promote the rights of older people. Advocates the further development of legal mechanisms that enhance the decision making power of older people and challenge their position in an ageist society. Suggests that lawyers, situated at the interface of the public legal system and the private world of abuse, can play a key role in achieving these goals.
