dc.description.notes | General overview: This US article looks at the need for family relocation and protection programs in the US for women and children in divorce and custody cases involving domestic violence.<br/ ><br/ >Method:The first part examines Nucito,:a New Jersey case where a divorce resulted in the relocation and change of identity of a battered woman and her children. Other relevant US caselaw and decisions are reviewed.<br/ ><br/ >Discussion:The remedy based on the US Federal Witness Protection Program from the Nucito:case is discussed as a model for an interstate or federal relocation program for domestic violence victims. The second part discusses the merits of such a program. The third part discusses the types of batterers this program would aim to protect against, a legal standard to assess whether a victim is eligible, and logistics of such proposed theoretical programs. The following 2 sections then discuss implementation problems at both state and federal levels, with the next section looking at potential issues that these programs may encounter. The last part gives an overall assessment of the feasibility of such programs.<br/ ><br/ >Results:A large scale relocation and protection program would cost a lot of money at the state and federal level. However, the statistics demonstrate that domestic violence is a serious criminal problem worthy of such programs on its merits. With existing programs for government witnesses and their families in criminal proceedings, it finds that implementing a similar provision for domestic violence victims would not difficult. Victims could be relocated like those in the Federal Witness Protection Program.<br/ ><br/ >Conclusions:It concludes that the adaptation of the Nucito:model on either level of government is the logical next step to provide relief for domestic violence victims. | en |
