This paper responds to an article published in the Sydney Morning Herald:, ‘Men deserve quid pro quo in custody legal aid’, on 13 November 2001. The newspaper article is critical of the Full Court’s decision in T and S [2001] FamCA 1147, assuming that it leads to the automatic grant of legal aid to women who allege domestic violence. Millbank argues that Janet Albrechtsen, the author, ignores the facts of the case and the court’s reasons for decision. A Family Court hearing with an unrepresented mother who claimed being a victim of severe domestic violence ordered that the child should live with the father. The appeal court recognised that women who have suffered domestic violence might be disadvantaged in presenting their cases without legal representation.
