dc.description.notesSpecial issue - Refugee Issues and Criminology<br/ >Discusses the position of the Australian government towards asylum petitions on the grounds of domestic violence. It is argued that the amendments to the Migration Legislation further narrow the possibility to obtain refuge for gender-based persecution allegations. The case of Mrs. Khawar is presented. The Full Federal Court rejected a decision of the Refugee Review Tribunal that denied refugee status to a woman who experienced domestic violence and was unable to obtain police protection in Pakistan. However, this outcome is not common. The insistence on allowing only Refugee Convention persecution – race, religion, political opinion and nationality – to obtain asylum ignores the risks endured by women due to their being women.en
