It is argued that the amendments to the Migration Legislation further narrow the possibility to obtain refuge for gender-based persecution allegations. The case of Mrs. Khawar is presented. The Full Federal Court rejected a decision of the Refugee Review Tribunal that denied refugee status to a woman who experienced domestic violence and was unable to obtain police protection in Pakistan. However, this outcome is not common. The insistence on allowing only Refugee Convention persecution – race, religion, political opinion and nationality – to obtain asylum ignores the risks endured by women due to their being women. | en |
