dc.description.notesThe Australian Law Reform Commission underwent an inquiry into the treatment of family violence in Commonwealth laws, especially in regards to child support, family assistance, immigration, employment, social security, privacy and superannuation. Income management law is an aspect of this social security law, in which a portion of a person's social security and family payment is quarantined to be spent on particular goods and services. The Commission was requested to consider if improvements could be made in relation to these legal frameworks to protect those experiencing family violence. The recommendations suggested that given the complexity of family violence, income management requires some flexibility and voluntary involvement so that people experiencing family violence can meet their needs and provide for their safety on their terms. This article explores the issue of family violence and the role of income management schemes, vulnerabilities in the scheme and amongst those living under it, and differences of compulsory and voluntary management measures. Proposing an alternative model such as the one applied in Cape York, the article addresses the ALRC recommendations for new approaches to income management in the context of family violence.
