The debate surrounding the appropriateness of mediation where domestic violence is present is considered and existing research into the effectiveness of mediation as a tool in divorce and custody settlements is reviewed. The study found approximately one third of participants attending mediation identified domestic violence as an issue and that while the occurrence of domestic violence was not determinative of mediation outcome, further attention to the role it plays in the mediation process and the potential for mediation to be manipulated through the power dynamics of the relationship, is needed. | en |
