dc.description.notes | Examines the outcome and implications of 46 relocation decisions over 18 months in the Canberra and Perth Family Court registries, attempting to identify the impact of particular variables including socio-demographic factors, children’s wishes, nature of relationship between spouses, reasons for relocation and process/application factors. A background to the project is provided, the decision in B v B being identified as a major impetus for the research. The results indicate that an application for relocation was most likely to be successful where the reason given for doing so was employment, or a desire to reunite with extended family and that allegations of violence would not necessarily lead to a successful application for relocation. Attempts to account for the findings through an analysis of three key themes: shared parenting and the emphasis placed on this notion by recent family law reforms; violence and the lack of credibility of women victims of domestic violence within the legal system; and ‘happy families’ or the best interests of the child as the court’s primary formal consideration. | en |
