dc.description.notesDiscusses developments, over the last decade, in international responses to violence against women, and how these developments have impacted on the position of Indigenous women who experience domestic violence. Outlines some of the major limitations of criminal justice responses to family violence in Indigenous communities and reviews recent attempts, in the United States, Canada and Australia, to develop alternative approaches to the problem. Highlights the tendency of these alternatives towards non-carceral forms of punishment and the risks, in terms of cultural perceptions of violence against women, associated with this shift. Argues that although the criminal justice system is in urgent need of reform, it has a unique potential to act as a protector and promoter of human rights norms, as embodied in international instruments and to ensure that these standards are incorporated into local structures and modes of punishment.en
