However, State and Territory child protection authorities do not have a general investigatory function when complaints of physical abuse, sexual abuse and neglect are raised before the courts. In order to establish an effective interaction between the state and federal systems, the Family Law Act 1975 (Cth) needs to be reformed. This paper proposes seventeen recommendations including the need for a Federal Child Protection Service; the role of State and Territory authorities; coordination between jurisdictions; and exclusion of evidence.en
