dc.description.notes | Presented at the 7th Australasian Conference on Child Abuse and Neglect, this paper discusses the role of the Family Court in cases involving child abuse allegations. A background to the nature and jurisdiction of the court is provided and it is stressed that its role extends beyond adjudication to providing a service to community members. The application of the Family Law Act 1975 and administrative protocols for dealing with child abuse allegations are then examined and some of the positive and negative aspects of current approaches highlighted. A background to and overview of the Magellan Pilot Program, a project aimed at ensuring better case management of family court cases involving child abuse allegations, are then presented. The paper concludes with a detailed examination of the role of the family court in cases of medical abuse of children, specifically the illegal sterilisation of adolescent girls, drawing attention to some recent court decisions, and debates the applicability of criminal law to such cases. | en |
