This paper is included in "9th National Family Law Conference : Sydney, July 2000" conference handbook.<br/ >Reviews the Family Court’s application of the principle of ‘fault’ in property disputes under ss 79 and 75(2) of the Family Law Act prior to the decision in Kennon v Kennon in which it was first recognised that family violence should be considered as relevant to spousal contribution. A brief summary of the decision in that case is provided and issues raised by a series of subsequent cases are identified. Concludes that the impact of the decision in Kennon, coupled with the loss of cross-vested jurisdiction in the Family Court, is difficult to assess and that in general, courts have been reluctant to lend weight to considerations of family violence in determining the contributions of spouses under s 79.en
