dc.description.notes | Provides a critical examination of state and community responses to the needs of victims of crime in the United States, advocating for the development of a new philosophical framework in assessing the adequacy of the civil and criminal justice systems in serving victims. Suggests that over the last thirty years, there has been two distinct strands of development in this area – a rights strand which has attempted to address the issue through policies, legislation and enhancement of constitutional rights, and a services strand that has resulted in the implementation of programmes and the provision of resources towards intervention with victims and perpetrators. Two new approaches currently underway are also examined – community justice and restorative justice. Some of the criticisms of these and previous strategies are outlined and it is argued that in all of these approaches, responses to the needs of victims have been limited by the conceptual framework from which agencies and practitioners have begun. It is suggested that in order to truly focus on the needs of victims, the pursuit of justice for victims must be distinct from the administration of justice for offenders such that the harm caused by crime can be both identified and addressed in its own right. | en |
