dc.description.notesThis Australian paper outlines the survey findings of the views of Queensland Magistrates in relation to domestic violence, conducted in May and June 2000. Of the 96 surveys sent, 38 responses were received, which represented a response rate of 40%. Key themes and issues identified through the survey are outlined, with 2 issues highlighted and discussed in detail. The highlighted issues are: 1. Magistrates' belief that women are using domestic violence proceedings as a tactic in family law matters; and 2. Magistrates' reluctance to issue ouster orders except in cases of severe physical violence. These issues are examined in the context that a majority of Magistrates in Queensland (71%) and NSW (90%) were found to believe that they are adequately trained to deal with domestic violence matters. However, it is argued that Magistrates' ongoing and specific training on domestic violence is necessary.en
