This discussion paper reviews the laws relating to family and domestic violence (FDV) in Western Australia (WA), especially the operation of the Restraining Orders Act 1997:(WA), and whether to separate family and domestic violence orders from that Act.

* Overview of the nature and extent of FDV, including major policy initiatives in WA and other Australian jurisdictions
* Findings from the WA Law Reform Commission’s public consultations on problems with the legal system’s response to FDV, and key objectives for reform
* Operation of the Restraining Orders Act 1997:(WA), including the police response to family and domestic violence
* Criminal justice responses to family and domestic violence, including criminal offences, criminal practice and procedure, and specialist family violence courts.
* Other legal responses to FDV, including interaction with the Family Court, victim rights, and criminal injuries compensation.
The paper contains (at Appendix A) a list of 53 proposals and 29 questions relating to the areas above, including a proposal for enactment of new and separate legislation, to be called the Family and Domestic Violence Protection Order Act:, which would set out a definition of FDV, grounds for making a FDV protection order, court processes, and police powers (Proposal 53).
