Notes: | This chapter provides an analysis and commentary of research and practice in making custody decisions with families who are experiencing high-conflict and/or domestic violence. The authors first provide an overview of the issues, prevalence and conflicting approaches between family court practitioners and victim advocates. This is followed by a detailed analysis of the practices involved with determining credibility of allegations including a discussion of unfounded allegations of abuse and differentiating among patterns of violence (coercive-controlling violence, conflict-instigated violence, violent resistance or separation-instigated violence). The authors propose an assessment model for use in making parenting decisions in custody disputes referred to as The P5 Screening:tool. The tool takes into account five features: potency of violence, patterns of violence, primary perpetrator of violence, parenting problems and preferences and perspectives of the child. The authors follow this with a detailed discussion of challenges and recommendations in making parenting arrangements and suggested considerations for primary parenting, parallel parenting and co-parenting arrangements. |
