Notes: | These guidelines on family violence form part of a package of best practice guidelines for lawyers doing family law work. The package also contains other items such as primary dispute resolution (screening and role of lawyers), costs, materials related to self-represented litigants, guidelines for property and spousal maintenance, cases involving children, child support and child maintenance, injunctions, and trials and appeals. Part 10 deals specifically with family violence, and reflects the law as at 29 March 2004. It defines family violence and outlines how family law lawyers could be prepared for family violence. It looks at client safety issues, State or Territory family violence proceedings and protection orders, and suggestions on compiling a record of evidence. The Best Practice guidelines were drafted by a joint committee of the Family Law Section of the Law Council of Australia and the Family Law Council. Appendices include notes on children’s contact services, material on family violence (suggested questions to ask clients to recognise family violence), and contact details for the Commonwealth Central Authority concerning overseas abductions. |
