Notes: | Based on existing research and theory, this chapter provides an overview of key elements necessary to establishing a healing environment for children of battered women in the post-separation or divorce period and identifies some of the ways in which batterer conduct can interfere in this process. The tendency for batterers to seek custody or increased visitation rights over children and potential motivators for this behaviour are discussed and some of the advantages batterers have within the (US) legal and court systems are examined. An assessment of batterer 'tactics' in custody and visitation disputes is undertaken and the ways in which such strategies can discredit allegations of abuse and undermine the safety of women and children are highlighted. The chapter concludes by summarising the key negative effects of custody litigation on children and suggesting the need for improved policy and practice in this area. |
