Part One is written by ‘Emily’ and tells her story of surviving an abusive relationship. Emily’s son Taylor also contributes his own reflections on witnessing and escaping family violence. In Part Two, some of the issues and themes emerging from Emily’s story are examined in more detail. The nature, incidence and consequences of domestic violence, sexual assault and children’s exposure to family violence are considered and the legal framework within which services are provided is outlined. The child protection system and ways of working within it is then examined and specific issues, such as mandatory reporting requirements, are addressed. The various ways of dealing with family violence through the legal system, including restraining and intervention orders, family court orders, civil actions and criminal prosecutions, are then explained and the inadequacies inherent within these approaches are highlighted. Specific issues arising in relation to the protection of children within the legal system are also considered. |
