Notes:  General overview:This Australian Family Law Courts brochure gives information on the principles that guide the Family Court and the Federal Magistrates Court in responding to family violence.

Objective and Method: It is available in the following 7 community languages as well as in English: Arabic, Chinese (simplified), Filipino, Serbian, Spanish, Turkish, and Vietnamese. In giving assistance, Court staff makes a judgment as to whether violence occurred or not. Their aim is to ensure all clients feel safe when coming to Court.

Discussion: Key contact numbers are listed for services such as domestic violence helpline support, crisis lines and courts registries across Australia. The seriousness of family violence, aspects which could be a criminal offence, and the different forms of family violence and how they could affect a person’s willingness to participate in the court process are outlined.

Results:Some of the guiding principles around concerns for family violence include: safety is a priority for all; that family violence affects everyone in a family including children; family violence can happen before, during and after separation and may affect the ability of people to make choices about their family law matter; and the longer term impacts on children.

Conclusions: Information that the Courts have to assist with: if there is an existing family violence order, you must tell the Courts before the first day of court event; your concerns about safety as separate rooms, appointments on different days or different entry and exit points can be arranged.
