Based on the findings from first phase of Partnerships Against Domestic Violence (PADV), this fact sheet has been developed for policy makers in the justice and legal sector. It summarises the key issues and reviews the literature on the role of the police, the role of courts, the impact of court orders and the family court. Issues and findings on women with disabilities and women in rural and remote communities are highlighted. Policy implications include: more effective responses to breaches of intervention orders; legal information provision to women; greater consideration of the impact of domestic violence on those affected in the Family Law Court at interim and final hearings; greater use of sole occupancy and exclusion orders; education of magistrates on the use and breaches of restraining and exclusion orders; more domestic violence courts; review of the Family Law Reform Act to clarify ‘shared parental responsibilities’ and provision for family courts to investigate allegations of domestic violence at interim hearings; and further evaluation of perpetrators’ programmes.
