Provides an overview of research and interventions into rape in marital relationships, tracing developments in policy and legislation over the past couple of decades, before highlighting some of the major gaps in current research, support and legal services for victims. Suggests there has been an historic reluctance to disclose, study or respond to incidents of marital rape, and some of the consequences this can have for women’s health and well-being are identified. The importance of changing cultural and community attitudes in addition to instituting legal and social reforms is emphasised.

Just two decades ago in most Australian states and territories, men were able to rape their wives with immunity. Rape in marriage was quite simply not a crime. While state legislatures have enacted laws that now address men’s licence to rape1 women with whom they share marital or established relationships, our understanding of whether this resulted in effectively changing the social, cultural and legal responses to sexual violence by male intimate partners is surprisingly limited.
