Examines some of the historical and social meanings attached to the concept of ‘protection’ for disadvantaged and/or marginalised individuals, highlighting some of the negative consequences which have resulted from both over-protection and a lack of clarity regarding to whom such protection should be afforded. Acknowledges the limited capability of legislation to guarantee protection to certain groups and questions whether a balance can be struck between denying autonomy to, and recognising the heightened vulnerability of, particular groups. Identifies specific groups for whom protection is a key concern and proposes a number of strategies for achieving a balance between autonomy and safety at a legal, policy, community and personal level. Concludes that a multiplicity and flexibility in response is critical to safeguarding the rights and dignity of those needing protection.
