Notes:  This is based on an interview with Cathy-Anne Grew, a solicitor practising in family law in NSW, about the proposals for change within the family law system. It gives a background to the current processes involved in using the family law system in the context of domestic violence, including the role of legal aid. It refers to the use of the Family Report in cases where there are allegations of sexual abuse, mental illness or substance abuse. It also mentions the Children’s Cases Program in the Parramatta and Sydney Registries of the Family Court. It proceeds to discuss the potential impact of the proposed changes such as equal parenting time and more frequent contact changeover as being problematic where the mother is subject to violence and harassment from her ex-partner. The child support system is also explored. Family Relationship Centres may also require training of staff and need for policies to deal with domestic violence and child abuse as there is a concern that, unless clients seek concurrent legal advice, they may not be aware of their legal rights and responsibilities and thereby enter into agreements or binding orders without being informed.
