Notes: | This article proposes a way to make mediation an equitable process for victims of domestic violence through the role of a lawyer advocate to help victims prepare for mediation, to represent and protect their interests during the mediation and to assist them with the terms of a final agreement. It provides an overview on whether mediation is an appropriate dispute resolution process where there is a history of domestic violence, and proposes a model of family law mediation that centralises the role of a legal advocate for the victim of domestic violence. |
