This article suggests making family law mediation an equitable process for victims of domestic violence by ensuring that victims have a lawyer advocate to prepare them for mediation, to protect their interests, and to help them with the terms and enforcement of a final agreement. It summarises the concerns over mediation as an inappropriate dispute resolution process where there is a history of domestic violence. It then outlines a mediation model that centralises a role for lawyers, including a lawyer’s pre-mediation role, a lawyer advocate’s role as victim’s representative in mediation and the role after mediation.
