Notes:  General Overview: This short Australian article considers the advantages and disadvantages of using mediation to resolve family law disputes, with a particular focus on family violence.

The author notes that mediation practitioners will be required to screen for family violence but research shows that mediators often fail to detect family violence. The benefits of mediation may include the quicker resolution of disputes, reduced cost to the parties and the government, increased cooperation between the parties and the empowerment of one or both parties. The disadvantages include the failure to ensure fair outcomes, the lack of accountability and the potential risks of abuse for victims of violence. The author notes that as it is likely that women who have experienced family violence will participate in mediation, their agency will focus on educating mediators about the impact of violence on women and how to increase safety for victims and their children.
