Title: | Human rights implications of ‘unlawful assault causing death’ laws |
Authors: | Ball, Rachel |
Keywords: | Legislation analysis;Criminal justice responses;Human rights |
Year: | 2012 |
Publisher: | Human Rights Law Centre |
Notes: | This Australian briefing paper examines the use of s.281 of the Criminal Code 1913:(WA) (‘unlawful assault causing death’) in the case of homicides that occur within the context of domestic violence relationships. This section of the Western Australian legislation allows a maximum sentence of 10 years but, to date, judgments of only two to five years have been imposed. Under the Criminal Code:a murder charge would attract a 20 year sentence. Ball highlights this situation as a violation of the victims’ human rights. |
