Notes:  This Australian briefing paper examines the use of s.281 of the Criminal Code 1913:(WA) (‘unlawful assault causing death’) in the case of homicides that occur within the context of domestic violence relationships. This section of the Western Australian legislation allows a maximum sentence of 10 years but, to date, judgments of only two to five years have been imposed. Under the Criminal Code:a murder charge would attract a 20 year sentence. Ball highlights this situation as a violation of the victims’ human rights.
