Notes:  Overview:This brief details the role Indigenous sentencing courts play and discusses the evaluations of these structures as well as the legal terrain in which they operate in the various Australian states and territories.

The paper contends that whilst Indigenous courts are being increasingly legitimised, the number of people who are sentenced in these courts is still quite low.

In order to improve the courts and their role in the community, evaluations of the courts recommended: additional material support for Elders and Respected Persons; further cross-cultural training of magistrates; the expansion of the courts into more (non-urban) areas for wider accessibility; increased support and rehabilitation programs for offenders; improved monitoring of courts; improved data collection.
