In November 1997, the Commonwealth Government presented a discussion paper proposing Model Domestic Violence Laws. This article critically appraises the content of the discussion paper with reference to local and international research and practice. The nature and complexity of domestic violence are ignored in the discussion paper by alleging that domestic violence legislation has been abused for family law or immigration purposes. Domestic violence is defined inadequately, excluding several forms of abuse and potential victims, such as people involved in same-sex and dating relationships. Significant attention is drawn to the inconsistencies between State and Territory laws concerning protection orders. However, the requirements proposed to obtain a protection order disregard the special circumstances of people who experience domestic violence. The discussion paper fails to offer any guiding principles or a model of best practice. Similarly, policy, practice and service delivery are not addressed.
