Notes: | Summarises some of the major changes to Western Australia’s laws brought about by the introduction of the Acts Amendment (Family and Domestic Violence) Act 2004 which was proclaimed on December 1, 2004. Resulting from a review of restraining orders and other domestic violence-related legislation, the Act broadens the definition of ‘family and domestic relationship’ and expands the grounds for obtaining a violence restraining order (VRO). It also allows a new ground for obtaining a VRO for a child where there is a family and domestic relationship, removes the consent defence to a breach of a restraining order, and obliges the police to investigate acts of domestic violence where personal safety is at risk. Penalties for a breach of a VRO have also been increased and changes to the Criminal Code will now result in higher maximum penalties: if the offender is in a domestic relationship with the victim; if a child was present when the offence was committed; or if the victim already had a restraining order against the offender. |
