Notes:  Representing the Domestic Violence and Incest Resource Centre (DVIRC), the authors discuss the final report of the Victorian Law Reform Commission (VLRC) into defences to homicide which was released in November 2004. They consider that the package of recommendations included in the report addresses the gender inequity inherent in the current legislation. Recommendations include the abolition of the provocation defence (which would disallow a claim that a perpetrator was provoked into violence by his partner’s actions) and reform to self-defence law which would allow an ‘inevitable’ threat as well as an ‘imminent’ threat to be justifiable cause for self-defence, thus allowing a charge of murder to be reduced to an acquittal. Provides a simplified flow-diagram comparing the current homicide law with a possible law taking VLRC recommendations into account. Illustrates reform of the law with two scenarios involving the killing of a partner comparing existing law with the recommended reforms.
