Notes:  This Strategy forms part of the Australian Government’s family law reform with the focus on the right of each child to grow up with support from both parents. This Strategy addresses family violence and child abuse in the context of the family law system and identifies ways to improve the operation of the system for these cases. There are 5 objectives and corresponding strategies on how to meet these objectives.

Objective 1:focuses on a better understanding of how family violence and child abuse issues arise in family law proceedings and how they are dealt with. This will be achieved through research into allegations of family violence and child abuse in family law proceedings, with the Australian Institute of Family Studies (AIFS) to conduct research on how allegations are raised and addressed in the family law system, as well as limitations of current research. Further longitudinal research will be commissioned into the impact of family violence and child abuse in family law matters. This objective will also be achieved by referral of significant family violence and child abuse issues to the Family Law Council.

Objective 3:looks at working collaboratively with the States and Territories, which will be achieved through the Standing Committee of Attorneys-General (SCAG) and Australasian Police Ministers’ Council (APMC).

Objective 4:aims to work with courts to improve their processes, which will be achieved through the family violence screening pilot in the Brisbane Registry; management of violence allegations within the preparation of family reports; piloting a child responsive model in the Melbourne Registry; the Children’s Cases Program; the Project Magellan and the Columbus Project.

Objective 5:aims to engage relevant stakeholders to identify further areas of improvement to the family law process. The Women’s Safety Agenda, Indigenous Family Violence Programs and the Family Violence Prevention Legal Services are also outlined.
