Reviews the current legislative framework within which child custody arrangements are negotiated before identifying the various ways in which proposed amendments to the Family Law Act will undermine the court’s capacity to act in the best interests of the child and place families escaping violence at a disadvantage. Specific emphasis is placed on the presumption in favour of shared residency contained in the new provisions and the safety risks such provisions entail. Advocates the replacement of current provisions with a rebuttable presumption in favour of no contact where family/domestic violence is an issue and that a range of factors, such as perpetrator involvement in a treatment programme, be considered in determining custody disputes.
