Title: Domestic violence against women with disabilities : a feminist legal theory analysis [Thesis]
Authors: Jones, Doug
Keywords: Disability
Population: People with disability
Year: 2007
Publisher: Doug Jones
Notes:  General Overview: This unpublished thesis from the United States explores the application of feminist legal theories to the challenge of violence against women with disabilities.

Discussion: The author begins with a discussion of the estimated prevalence of violence against women with disabilities and provides several scenarios to explore how these women may be more vulnerable to violence. The author argues that feminist legal theorists have overlooked the issue of domestic violence against women with disabilities because of an essentialist view which does not take into account the different needs and experiences of women. He examines the different ways in which women with disabilities experience abuse, the additional barriers these women experience in escaping domestic violence and the myths that may prevent a woman with disabilities from realising she is experiencing abuse.

Conclusions: The author proposes the use of both test cases and legislative reform to ensure refuges, courts and other services are accessible to disabled women. He argues that domestic violence services should extend education programs about disability aimed at service providers. He calls for the dispelling of myths about disabled women and for courtroom accommodations (such as expert testimony or jury instruction to explain why women with disabilities stay with their abuser). Finally, he proposes that disabled women should be allowed to have charges against their abusive partners dropped, if they rely on the partner for care.
