Notes:	Overview: This report reviews the sentencing of family violence defendants and the penalties imposed for a breach of family violence intervention orders in Victoria. Discussion: In response to the 2006 Victorian Law Reform Commission’s report on family violence laws, the Sentencing Advisory Council reviewed relevant literature, analysed data and consulted with professionals involved in the sentencing of those in breach of intervention orders. Further, these consultations discussed whether or not sentences are effective in fulfilling their purposes. The report states that the purposes of sentences are punishment, deterrence, rehabilitation, denunciation and/or community protection. The over-all purpose of the sentence is to protect the victim from harm and further violence. The report emphasises that this must be taken into account, especially when administering punishments such as fines, which may financially punish the victim as well as the offender. Sentences that include rehabilitation are also a strategy to be considered. The Sentencing Advisory Council makes several recommendations including that: men’s behavioural change programs be tied to sentencing orders; behavioural change programs be evaluated; that the Victorian police implement a system upon breach of a violence intervention order that requires them to evaluate whether the order is appropriate.
