dc.description.notesSee also: Defences to homicide : options paper:on our Research & Resources database<br/ >Drawing together over three years of research and consultation, this report presents the findings and recommendations of the Victorian Law Reform Commission’s examination of defences and partial defences to homicide under current Victorian legislation and provides a model for implementing suggested reforms. A background to the report and the social context of homicide is provided in Chapter 1, while Chapters 2 and 3 address the limitations of and justifications for the law of provocation and self defence. In Chapter 4, specific evidentiary issues arising where the accused was either a victim or perpetrator of prior family violence are considered, and Chapter 5 outlines the debate over the culpability of persons with mentally impaired functioning who kill. The alternative verdict of infanticide and arguments for and against its retention are discussed in Chapter 6, and Chapter 7 utilises a series of case studies to highlight key issues in the sentencing process and the need for reform in this area. The appendix includes a Draft Bill to implement recommended changes to current legislation and an explanatory memorandum.en
