Notes: | Provides a brief history of the approach to domestic and family violence taken by the Family Court since its establishment in 1975, before reviewing some of the key legislative changes brought about by the introduction of the Family Law Act 1995 (Cth). Specific attention is given to the requirement, under the new legislation, that parenting/contact orders be consistent, as far as possible, with family violence orders and the manner in which this provision has been implemented by the Family Court. The significant role accorded to State Magistrates under the scheme is highlighted and some potential consequences of new Act are suggested. |
