dc.description.notes | "February 1998"<br/ >Provides a comprehensive statistical overview of restraining orders and stalking offences in the Magistrates Courts of South Australia during 1995 and 1996. Restraining orders come in three types: general, domestic violence and paedophile. Almost half of all applications were for domestic violence restraining orders, taken out against a family member, as defined by the Domestic Violence act of 1994. Approximately two-thirds of applications under this Act 1994 were issued without change, and applications were less likely under this Act than for ‘general’ applications to be withdrawn by the complainant or dismissed/refused by the magistrate. Over 95% of restraining order defendants were male. Over 36% of all breaches of the order were for domestic violence restraining orders.<br/ >In 1995 there were 17 cases involving 28 stalking offences finalised in the Magistrates Court, and 12 cases involving 36 offences in 1996. Only three of the 29 cases involved a female defendant. Only 15 of the 64 stalking offences finalised in 1995 and 1996 resulted in a conviction. Only six stalking victims did not know their stalker. | en |
