dc.description.notes | General Overview: This report chapter looks at Australian Indigenous customary laws that relate to family matters and makes recommendations on how they may be dealt with in the context of Western Australian legislation. The authors take into account various state laws that deal with the same issues that customary laws do, noting conflicts as well as areas in which customary laws can be accommodated.<br/ ><br/ >Objective: The report chapter sets out issues of conflict and similarity between Indigenous customary law, Commonwealth family law and Western Australian family law provisions. The chapter includes recommendations for changes to existing WA legislation where some issues have not been resolved.<br/ ><br/ >Discussion:The report chapter discusses a range of issues arising from conflict between Indigenous customary law, Commonwealth family law and Western Australian family law provisions including:<br/ ><br/ >Conclusions: The report chapter makes a number of recommendations for each of these issues, including:<br/ >* With regard to Family Court disputes, to enhance culturally appropriate services in Western Australia<br/ >* With regard to family violence, to promote education on legal rights of women and children and the criminality of sexual child abuse. It recommends developing community based and owned Aboriginal family violence intervention projects. In addition, it recommends providing resources for the provision of men's counselling, treatment and accommodation for male perpetrators, including ongoing evaluation and monitoring. | en |
