Notes:  This paper argues that human rights to safety for women and children are at risk in the Australian family law system and calls for an urgent need for reform. It summarises key statistics or data on the family homicide rates in Australia, which indicate that the mothers and children experience significant harms, injuries and deaths from violent partners. It argues that family law frameworks re-expose mothers and children to abuse, and outlines issues such as barriers to legal assistance, judicial officers’ attitudes, children’s representation and child contact. Some of the challenges discussed include: Constitutional divisions; state responses to domestic violence and child protection; lack of legal aid and the pro-contact culture of family law.
