Notes: | This paper provides an overview of the Family Court’s Family Violence Strategy in Australia, and gives some practical ideas to support workers and women who are involved with the Family Court in the context of family violence. Building on 8 guiding principles, the Strategy proposes 5 key areas of action to address family violence in the Family Court. The 8 guiding principles are: 1. Primacy of safety; 2. Recognition of the Impact of Family Violence; 3. Recognition of the Impact of Violence on Children; 4. Recognition of the Diversity of the Court’s Clients; 5. Risk Assessment Approach; 7. Community Partnership Approach; 8. Importance of Development Programs. The 5 key areas for action are: (i) Information and communication; (ii) Safety; (iii) Training; (iv) Resolving the dispute; (v) Making the decision (evidence of expert witnesses; improved family reports). Second part of the paper gives information for support workers and their clients such as how to prepare the client for the Court; role of case coordinators; attending Court (including children); expert evidence; expert witness; and subpoenas. |
