Notes:  This paper presents the first survey findings on the views of Queensland Magistrates in relation to domestic violence, conducted in May and June 2000. Of the 96 surveys sent, 38 responses were received, which represents a response rate of 40%. Two of the identified key issues are: Magistrates’ belief that women are using domestic violence as a tactic in family law matters; and Magistrates’ reluctance to make ouster orders except in cases of extreme physical violence. It is argued that such beliefs are contrary to research and literature, and such attitudes reduce the justice available for women who are victims of domestic violence.
