Notes:	General Overview: :This report was commissioned by the Tasmanian Department of Justice. It reviews the first three years of the operation of the Family Violence Act 2004. Discussion: :The evaluators, (Urbis) conducted consultations and received submissions from stakeholders, including government departments, academics, legal services, magistrates, police and non-government organisations. They note that it is not yet possible to know whether family violence is decreasing as a result of the introduction of the Family Violence Act 2004. There is considerable satisfaction amongst those consulted with the improved police response and a perception that the adult victims of family violence are safer. There is concern that the safety of children is not being prioritised. There is not yet evidence as to whether the legislation and the referral of offenders to an intervention program are resulting in reduced offending. There are concerns about the bail provisions, which reverse the usual presumption in favour of bail. Recommendations are made to improve the operation of the legislation.
