Notes: | These explanatory notes relate to the Domestic Violence, Crime and Victims Bill introduced in the House of Lords, United Kingdom Parliament, in December 2003. This Bill aims to provide civil and criminal law reforms on domestic violence by: improving the legal protection available to victims of domestic violence (reforms to the UK Family Law Act on non-molestation and occupation orders); and providing greater clarity for police when attending domestic violence incidents. It criminalises the breach of non-molestation orders under the UK Family Law Act, extends the availability of restraining orders and makes common assault an arrestable offence. Provisions on familial homicide introduce a new offence of causing or allowing the death of a child or vulnerable adult, where it will not be necessary to show which member/s of the household have caused the death. All household members (subject to restrictions on age and mental capacity) will be liable if they meet the criteria. The Bill sets out arrangements for the establishment and conduct of domestic violence homicide reviews. There are provisions on victims and witnesses: code of practice on the services to be provided to victims to replace the non-statutory standards of the Victims’ Charter. |
